Overview

Welcome to Mosaic. The terms "we", "us", and "our" refer to Mosaic Social Wellness Club. Mosaic operates this membership-based store and website, including all related content, products, and services (the "Services"). The Services are powered by Shopify, with subscription management by Recharge and scheduling by Calendly. These Terms, together with any policies referenced here, describe your rights and responsibilities when you use the Services.

Please read these Terms carefully. They include important information about your legal rights, warranty disclaimers, and limitations of liability. By visiting, interacting with, or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Services.

Important: What Mosaic Is and Is Not

Mosaic products (including Enlighten Micro Caps, Weekender, Enlighten Samples, and Sidekick) are psilocybin microdosing supplements intended for adult use within a considered personal practice. They are not intended to diagnose, treat, cure, or prevent any disease. Mosaic is not a clinic. Mapping and Concierge are supportive conversations, not medical or clinical care, and nothing in the Services constitutes medical advice. If you are considering a change to your health routine, consult a qualified healthcare professional. Access requires a completed application, a Mapping consultation, and approval. Mosaic reserves the right to decline or discontinue access at its discretion.

Section 1: Access and Account

By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence. The Services are intended only for adults.

To access Mosaic's products, you must submit an application at /pages/apply, complete a complimentary 20-minute Mapping consultation via Calendly, and be approved. If you were referred by an existing member, your application may be tagged accordingly. Once approved, you may subscribe to Membership through Recharge; your account is tagged Approved, Active Subscriber, and recharge_active_subscriber as appropriate.

You represent and warrant that all information you provide is accurate, current, and complete. You are solely responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You may not transfer, sell, assign, or license your account.

Section 2: Our Products

We make reasonable efforts to describe our products accurately, but colors, packaging, and appearance may differ from how they display on your device. We do not warrant that products will meet your subjective expectations. Product descriptions, formats, and availability are subject to change at our discretion, and we may limit quantities per person, region, or jurisdiction.

Mosaic Membership is a recurring subscription managed through Recharge. You can review, pause, skip, or cancel your subscription according to the terms disclosed at checkout and in your member account. Weekender and Sidekick may be available only to approved members on a limited basis.

Section 3: Orders

When you place an order, you are making an offer to purchase. Mosaic reserves the right to accept or decline any order at our discretion, including where a customer is not approved, has violated these Terms, or where we suspect fraud. Your order is accepted only when we confirm it. We must receive and process your payment before an order is accepted. Please review your order carefully. We may be unable to accommodate changes or cancellations once accepted. Purchases are subject to return or exchange only in accordance with any applicable return policy.

You represent and warrant that your purchases are for your own personal use within a considered microdosing practice, and not for commercial resale, redistribution, or export. Reselling or redistributing Mosaic products is strictly prohibited.

Section 4: Prices and Billing

Prices, discounts, and promotions are subject to change without notice. The price charged for a product will be the price in effect at the time your order is accepted and shown in your order confirmation. Unless stated otherwise, posted prices do not include taxes, shipping, or handling.

Subscription pricing is governed by the Recharge terms disclosed at checkout. By subscribing, you authorize Mosaic (through Recharge) to charge your payment method on each billing cycle until you cancel. You agree to keep your account and payment information current.

You represent and warrant that (i) the payment information you provide is true, correct, and complete; (ii) you are authorized to use the payment method; and (iii) you will pay all charges at posted prices, including taxes and shipping.

Section 5: Shipping and Delivery

Shipping is governed by our Shipping Policy. Delivery times are estimates only and are not guaranteed. We are not liable for delays caused by carriers, customs, or events outside our control. Once products are transferred to the carrier, title and risk of loss pass to you.

Section 6: Mapping, Concierge, and Member Content

Mapping is a complimentary, approximately 20-minute consultation offered to applicants. Concierge is a separate guidance conversation available to approved members. Both are booked through Calendly. These conversations are informational and reflective; they are not medical care, and they do not create a provider-patient relationship. Any guidance shared is general in nature and not a substitute for advice from a qualified healthcare professional.

If you participate in Reflections or any member survey, you understand that your responses are stored by Mosaic (via Vercel and Supabase) and may be used in de-identified, aggregate form to improve the Services and our editorial content.

Section 7: Intellectual Property

The Services, including all trademarks, text, imagery, product photography, editorial content, field notes, Science articles, designs, and the selection and arrangement thereof, are owned by Mosaic or its licensors and are protected by U.S. and international intellectual property laws. These Terms permit you to use the Services for personal, non-commercial use only. You may not reproduce, distribute, modify, publicly display, republish, download, or transmit any material from the Services without our prior written consent.

"Mosaic", "Enlighten", "Weekender", "Sidekick", "Mapping", and "Concierge" are trademarks or claimed marks of Mosaic. You may not use these marks without our prior written permission.

Section 8: Third-Party Tools and Links

The Services use and integrate with third-party tools, including Shopify, Recharge, Klaviyo, Calendly, Vercel, Supabase, and Google Analytics. We provide access to these integrations "as is" and make no warranties about them. Your use of any third-party tool is subject to that provider's own terms and privacy policy. The Services may also link to third-party websites that we do not control; we are not responsible for their content, products, or practices.

Section 9: Relationship with Shopify

Mosaic is powered by Shopify, which enables us to provide the Services to you. Sales and purchases are made directly with Mosaic. By using the Services, you acknowledge that Shopify is not responsible for any aspect of any sale between you and Mosaic, including any injury, damage, or loss resulting from purchased products or services. You release Shopify and its affiliates from all claims arising from or related to your transactions with Mosaic.

Section 10: Privacy

All personal information we collect is subject to our Privacy Policy. Certain information may also be subject to the Shopify Consumer Privacy Policy. By using the Services, you acknowledge that you have read these policies.

Section 11: Feedback and User Submissions

If you submit ideas, suggestions, reviews, Reflections responses, or other content ("Feedback"), you grant Mosaic a perpetual, worldwide, royalty-free, sublicensable license to use, reproduce, modify, publish, distribute, and display that Feedback (in de-identified or aggregate form where it originated inside a member survey) for any purpose, including improving the Services and our editorial content. You represent that you own or have the necessary rights to the Feedback you submit and that it does not violate anyone else's rights.

Section 12: Prohibited Uses

You may use the Services only for lawful purposes. You agree not to: (a) use the Services for any unlawful or harmful purpose; (b) violate any applicable law or regulation; (c) infringe on anyone's intellectual property; (d) harass, abuse, or harm any person; (e) impersonate another person or entity; (f) attempt to gain unauthorized access to the Services or any account; (g) use the Services to transmit spam, chain letters, or similar unsolicited content; (h) upload viruses or malicious code; (i) scrape, crawl, or otherwise collect data from the Services without permission; or (j) resell or redistribute Mosaic products or Membership access. We reserve the right to suspend or terminate your account at any time without notice if we believe you have violated these Terms.

Section 13: Termination

We may terminate this agreement or your access to the Services at our discretion at any time, with or without notice. On termination, you remain liable for amounts owed up to the date of termination. Sections that by their nature should survive termination (including Intellectual Property, Feedback, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law, and these Terms generally) survive.

Section 14: Disclaimer of Warranties

The Services and all products offered through the Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Mosaic makes no claims that any product will produce any particular outcome, mood, or state. We do not guarantee that the Services will be uninterrupted, secure, or error-free. Some jurisdictions do not allow the disclaimer of implied warranties, so some of the above may not apply to you.

Section 15: Limitation of Liability

To the fullest extent permitted by law, in no event shall Mosaic, its officers, employees, affiliates, agents, contractors, service providers, or licensors (or those of Shopify and its affiliates) be liable for any indirect, incidental, punitive, special, or consequential damages, including lost profits, lost revenue, lost data, or similar damages, arising from your use of the Services or any product purchased through the Services, even if advised of the possibility of such damages.

Section 16: Indemnification

You agree to indemnify, defend, and hold harmless Mosaic, Shopify, and our affiliates, officers, directors, employees, agents, and service providers from any losses, damages, liabilities, or claims (including reasonable attorneys' fees) arising from (1) your breach of these Terms or any referenced policy, (2) your violation of any law or the rights of any third party, or (3) your access to and use of the Services.

Section 17: Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be enforceable to the fullest extent permitted, and the unenforceable portion shall be severed from these Terms without affecting the validity of the remaining provisions.

Section 18: Waiver and Entire Agreement

Our failure to enforce any right or provision shall not constitute a waiver. These Terms and any policies posted by us constitute the entire agreement between you and Mosaic and supersede any prior agreements.

Section 19: Assignment

You may not assign these Terms or any rights or obligations under them without our prior written consent. We may assign these Terms without consent or notice.

Section 20: Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. You and Mosaic consent to venue and personal jurisdiction in the state and federal courts located in San Mateo County, California.

Section 21: Changes to These Terms

We may update these Terms from time to time by posting a revised version on this page. We will update the "Last updated" date and, where required, notify you of material changes. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
